TERMS AND CONDITIONS
DEPOSITS
​
A deposit will be taken prior to the session, the deposit is non-refundable or transferable should the session be cancelled. Should sessions be postponed to a later date Glenn Davidson Photography will retain the deposit on the understanding that the session will be re-scheduled to a new date and time.

PAYMENTS
​
Payment will be due on or before the date of the session. Clients will not receive photographs until payment has been made in full. Clients may select an agreed number of additional photographs, payment for additional photographs must be made at the point of ordering. No unedited images will be supplied.

COPYRIGHT
​
Glenn Davidson Photography retains the copyright for the photographs at all times throughout the world and without a time limit. Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means, an image created as part of this agreement without the express written permission of Glenn Davidson Photography.

Glenn Davidson Photography supplies the technical and artistic ability to illustrate an idea photographically and sells the right to reproduce those pictures in a given context. No property or copyright in any pictures shall pass to the Client whether on its submission or on Glenn Davidson Photography’ grant of reproduction rights in respect thereof.

RIGHT TO A CREDIT
​
Glenn Davidson Photography retains the right to always be identified as the author of his work retaining the right to a credit in keeping with the Copyright, Designs and Patents Act 1988(s 77 and 78), or any amendment or re-enactment thereof. Please always credit as follows ‘Glenn Davidson Photography’.

USAGE OF PHOTOGRAPHS
​
Photographs may be used for the purpose of self-promotion and business promotion by clients (or agent on their behalf) actor/model/performer. All use is subject to the accreditation of Glenn Davidson Photography.
​The client does not have the right to reproduce the photographs without the express written permission of Glenn Davidson Photography, any use without permission would be seen as a breach of copyright. When reproduction rights are granted they relate to the Client only and may not be assigned, nor loaned or transferred to third parties.
​
Any reproduction rights granted are by way of licence and no partial or other assignment of copyright shall be implied.
Glenn Davidson Photography reserves the right to refuse to supply or grant a reproduction licence to a third party when requested to do so by the Client.

FORCE MAJEURE
​
The due performance of this agreement is subject to alteration or cancellation by either party owing to any cause beyond their control.
​
LIMITATION OF LIABILITY
​
In the unlikely event of equipment failure or cancellation of this agreement by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the agreement. Neither party shall be liable for indirect or consequential loss. Glenn Davidson Photography takes the utmost care with respect to exposure, transportation and processing of photographs, including using professional-grade equipment and professional-grade back-up equipment. However, in the unlikely event of the client's photographs being lost, stolen, or destroyed for reasons within or beyond the control of Glenn Davidson Photography, the latter's liability is limited to the return of all payments received for the package. The limit of liability shall not exceed the contract price stated herein. The limit of liability for a partial loss of originals shall be a pro-rata amount of the exposures lost based on the percentage of the total number of originals.

CANCELLATION
​
Once a booking has been made Glenn Davidson Photography will hold the session slot and not book other work at this time.
​
Glenn Davidson Photography reserves the right to rearrange, cancel or postpone a session; in such circumstances, the deposit is fully repayable.
​
DIGITAL FILES
​
All digital files are the property of Glenn Davidson Photography.
​
IMAGE STORAGE
​
Glenn Davidson Photography will store all images for no more than two years. An administration fee plus photograph fee will be charged for any copies. Should photographs be lost during this period (2 years) Glenn Davidson Photography cannot be held liable for this loss.
​
PERFORMANCE
​
The performance of this agreement on behalf of Glenn Davidson Photography shall be contingent upon force majeure, flood, fire, warfare, government laws or regulations, electrical failure, strikes by suppliers, and/or conditions beyond its control.
​
PERSONAL CAMERAS
​
Clients are asked not to bring personal cameras to the shoot or to take images of the photographs on mobile phones. Glenn Davidson Photography retains all copyright for these images.
​
REJECTION
​
The Client has no right to reject the Images on the basis of style, composition or editing.
​
APPLICABLE LAW
​
This agreement shall be governed by the laws of England and Wales.
​
VARIATION
​
These Terms and Conditions shall not be varied except by agreement in writing.
